Overview

The Counsel will conduct research and provide legal counsel on a variety of legal matters affecting Kentucky Farm Bureau Insurance Companies.  The person’s primary focus will be to provide support to Sr. Litigation Counsel supporting areas affected by litigation, principally the Claim Department.

Responsibilities

Establish and maintain a thorough and continuing understanding of the laws that affect the Company and the Claim Department, particularly laws pertaining to the corporations, claims handling, and the discovery process.

Commitment to supporting and applying KFB’s Guiding Principles in your daily work.

Assist in keeping the Claim Department and other assigned departments and functional areas informed of changes in the law.

Perform a variety of activities necessary for the operations of a Corporate Legal Department.

Maintain a thorough knowledge of the Kentucky Insurance Code and Kentucky Insurance Regulations.

Apply legal principles to issues and questions presented and provide practical solutions using good analysis and judgment.

Exhibit excellent communication skills and build successful relationships with departments and corporate personnel.

Attend and participate in a variety of meetings and hearings on behalf of the Company when requested.

Research legal issues and problems as requested.

Keep Vice President, Legal Services informed of activities.

Maintain regular, predictable attendance as employee has to physically be in the office.

Other Responsibilities

 

Conduct exhaustive and accurate research according to priorities established by Vice President, Legal Services.  Legal issues and problems should be researched and studied thoroughly and with detail.

Retain opinions and memorandums written and add these documents to the Legal Department brief and research bank, including documents from internal and external sources.  Help maintain and organize this research brief bank.

Draft quality opinions and/or memorandums as requested by Vice President, Legal Services, Claim Department management and other management personnel.

Subject to unusual circumstances, provide opinions and/or memorandums to the requesting party within two weeks, and preferably within one week.

Attend pertinent continuing legal education programs and seminars approved by Vice President, Legal Services.

Be aware of the legal relationship between the Kentucky Farm Bureau Insurance Companies, Kentucky Farm Bureau Federation, Southern Farm Bureau Life Insurance Company, and the subsidiaries of the various organizations.

Abstract all relevant court decisions for the Law Manual used by the Claim Department.  Such update should be done at least once a year.  Between updates, keep the Claim Department informed of recent cases in a timely manner.

As requested by Vice President, Legal Services, attend hearings before the Commissioner of Insurance to resolve issues between the Company and Department of Insurance.

Become familiar with all Company contracts, including agent's contracts and insurance policy contracts.

Review and maintain knowledge of the corporate documents for the Kentucky Farm Bureau Mutual Insurance Company and its subsidiaries.

Assist and provide counsel to the Litigation Manager and other personnel managing litigation in the Claim Department as needed.

Establish and maintain a working knowledge of the legal research database subscribed to by the Company.

Attend Farm Bureau meetings and, if necessary, discuss legal issues at said meetings.

Meet with attorneys and claim personnel on legal matters when appropriate.

Review and prepare any necessary contracts or legal documents.

Coordinate responses to subpoenas seeking corporate information.

Handle and process civil lawsuits served on the Company.

 

Job Specifications

 

Physical demands: Normal vision/hearing with or without correction; Must be able to drive a motor vehicle; May include overnight travel.

Mental demands: Analytical; Concentration; Time pressure; Public speaking required.

Environmental factors: Standard office lighting, temperature, and noise.

Equipment: Telephone/Dictaphone; Personal computer; Motor vehicle; Copier.

Qualifications

Graduate of an accredited law school; Juris Doctor Degree required.

Two years' experience in the practice of law in Kentucky is required; experience in litigation, contract law, human resources, immigration, a governmental agency or insurance company preferred.

A license to practice law in Kentucky is required; admitted to practice in both State and Federal courts of Kentucky preferred.

Ability to do research on all legal problems pertaining to insurance.

Excellent communication skills – reading, writing and oral.

Experience in writing legal memoranda and briefs.
